These Terms are written to describe the product plainly. Nothing here is legal advice about your own rights, and the disclaimers in sections 2 to 4 are the ones that decide what Deep Oʻahu output may be relied on for.

1. The agreement

These Terms are between you and Deep Oahu LLC, 2525 Date St, Honolulu, HI 96826, which operates Deep Oʻahu at deepoahu.com. By using the site you agree to them. If you do not agree, do not use the site.

If you buy something from us, the order confirmation, invoice or checkout terms for that purchase sit alongside these Terms and control where they expressly conflict with them for that purchase.

2. What Deep Oʻahu is

Deep Oʻahu is a research tool for property on Oʻahu, built on public records. It brings together parcel geometry, county assessment and ownership records, zoning, building permits, FEMA flood zones, sea-level-rise mapping, mapped cesspool evidence and Department of Health priority bands, short-term-rental registrations, aerial imagery, and other public datasets, and it presents each field with the source it came from and the date that source carries. The datasets and their limitations are described on our Data and methodology page.

Deep Oʻahu is a research tool, not a survey, appraisal, title report, engineering report, legal opinion, or insurance determination. It is also not a broker, a lender, a title company, or a consumer reporting agency, and its output is not a title search, a boundary determination, a valuation, a zoning determination, a permit approval, a flood-insurance determination, or a guarantee about a property's condition, value, legality, insurability, buildability, view, boundary, access or future use.

Deep Oʻahu publishes measurements alongside public records, and labels which is which. A measurement is an observation drawn from geospatial evidence, published with the evidence behind it. It is not a professional determination and it is not a guarantee of a particular result.

3. No professional advice

Nothing on Deep Oʻahu is professional advice, and using the site does not create a professional relationship of any kind. Before you act on anything you find here — buying, selling, building, renting, insuring, lending, valuing, or deciding not to do any of those — verify the material facts with the authoritative source and, where it matters, with a licensed surveyor, attorney, appraiser, engineer, architect, inspector, broker, insurer, lender or contractor. That verification is your responsibility, not ours.

4. Public records have limits, and you must check the source

Deep Oʻahu is a copy of public records, not the records themselves. Public records are published on their own schedules, are sometimes wrong, are sometimes corrected later, use their own definitions, and can be withdrawn or restructured without notice. A record that was accurate on the day it was published may not describe the property today.

Concretely, and this is not an exhaustive list:

  • Ownership and assessment come from the county assessment roll. They are not a title search and they do not establish who owns anything.
  • Parcel geometry is a mapping product with positional uncertainty. It is not a boundary survey, and a line on our map is not a line on the ground.
  • Spatial overlaps are not facts about people. That a parcel intersects a mapped zone, a flood polygon or a nearby record does not prove anything about a specific person, unit, resident, meter or structure.
  • Permit history shows permits that were issued. It does not show unpermitted work, and the absence of a permit is not evidence that work was unpermitted.
  • Flood and sea-level-rise layers are official mapping context. They are not a flood-insurance determination, a risk score, or a prediction.
  • Short-term-rental records show current registrations. They do not tell you whether a property may lawfully be used as a short-term rental.
  • Aerial imagery is a capture from a specific year. It shows what was there on the day it was flown.
  • Derived values — anything we calculate from source data rather than read out of it — are labeled as such, and a calculation is not an original source statement.

Where a decision matters, go to the source. Our Data and methodology page names every source so you can.

5. Acceptable use

You may use Deep Oʻahu to research property. You may not:

Take the data in bulk

  • scrape, crawl, harvest, spider, or otherwise systematically extract data from the site or its endpoints by automated means, except for well-behaved search-engine crawlers obeying our robots.txt;
  • exceed published or applied rate limits, run concurrent automated clients, or evade a rate limit, block, or access control by rotating addresses, identities or accounts;
  • reproduce, resell, sublicense, redistribute or publish substantial portions of the site's data, or use it to build or train a competing dataset, index or product;
  • strip source, copyright, attribution, provenance or limitation notices from anything you export or share.

If you want data in bulk, that is a real conversation and we would rather have it — see section 9. The prohibition is on taking it, not on asking for it.

Use it against people

  • use the site or its data to harass, stalk, threaten, intimidate or locate any person, or to compile a dossier on an individual;
  • use the site or its data to make, support, or justify a discriminatory housing decision. Federal fair-housing law and Hawaiʻi law prohibit discrimination in the sale, rental, financing, appraisal, advertising and marketing of housing on the basis of protected characteristics. You may not use Deep Oʻahu to steer, target, exclude, screen or price by neighborhood, demographic proxy, or any protected characteristic, or to build an audience or model that does.
  • use the site or its data as a factor in eligibility for credit, insurance, employment, tenancy or any other purpose covered by the federal Fair Credit Reporting Act. Deep Oʻahu is not a consumer reporting agency and nothing it produces is a consumer report.

Interfere with the service

  • break the law, or infringe or violate anyone's rights, using the site;
  • probe, attack, overload or disrupt the site or the systems behind it, or attempt to bypass authentication or security;
  • upload or transmit malicious code;
  • present Deep Oʻahu output as an official government record, a survey, an appraisal, an engineering determination or any other professional certification, or otherwise misrepresent what it is;
  • share account credentials, or use one account to serve users who should have their own.

We may rate-limit, suspend or block access — with or without notice — to protect the service, and we may terminate an account for a material or repeated breach of this section.

6. Accounts

You are responsible for the accuracy of what you tell us, for keeping your credentials secure, and for everything done through your account. Tell us promptly if you think your account has been compromised. You must be at least 18 and able to enter a contract. We may suspend or close an account for non-payment, for breach of these Terms, or where continued access threatens the service or other users.

7. Subscriptions and billing

Prices are published on the pricing page. Before any charge we confirm the product, the price and the scope in writing. These billing terms apply, and they are written to be the ones we keep:

  • Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, until you cancel.
  • Cancel any time. One message, and no retention flow that hides the button. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then.
  • No partial-month refunds on monthly plans. Access continues to the end of the paid period.
  • 14-day refund on a first monthly subscription, in full, no questions asked.
  • Annual plans: full refund within 30 days of purchase; after that, a pro-rata refund of complete unused months on request.
  • Annual team contracts are non-refundable after 30 days except where the law requires otherwise. Seats may be reallocated at any time and the seat count may be reduced at renewal.
  • If we materially reduce or remove a feature you are paying for, you may cancel and get a pro-rata refund of the rest of the current period.
  • Founding price lock. A founding rate applies for 12 months from activation and survives a general price rise. It does not survive cancelling and re-subscribing.
  • Price changes never apply mid-period, and we will give at least 30 days' notice before the renewal a new price takes effect on.
  • We may cancel your subscription for non-payment after notice, for breach of section 5, or if we discontinue a plan — and in that last case we refund pro rata.
  • Your saved research survives. If a subscription lapses or is cancelled, saved properties, searches and watchlists are kept read-only for 12 months and can be exported at any time in that window. We do not delete your work to create pressure.
  • All amounts are in US dollars and exclude any applicable tax, including Hawaiʻi general excise tax where it applies.

8. Property Intelligence Reports

A Property Intelligence Report is a document we assemble for one property from public records, with a source and a date on every field. What is in it is exactly what the public record supports on the day we write it — we do not add analysis we cannot evidence, and we will tell you before you order if what you want is not something the record can answer.

  • Turnaround. Our target is two business days from a confirmed order.
  • Refundable in full before we start work. Once the report is delivered it is not refundable, because it cannot be returned.
  • If a report is wrong against its own cited source, we correct it at no charge, and if we cannot correct it we refund it in full.
  • If we miss the delivery target by more than three business days and you no longer want the report, we refund it in full.
  • A report is for you. You may use it and share it in your own transaction or with your own client. You may not resell it, publish it, or use it as the basis of a product.
  • A report is a research document. It is not an inspection, an appraisal, a survey, a title report or an insurance determination, and it does not replace one. Everything in section 3 and section 4 applies to it in full.

9. API and bulk data

There is no API or data product on offer today, and no published price for one. Any API, bulk-data or redistribution access is by separate written agreement, which will set its own licence, scope, attribution obligations, rate limits, term and fees, and which controls over these Terms for that access. Some of our sources are usable for research but not for redistribution, so a data licence is genuinely a source-by-source conversation rather than a form.

10. Intellectual property and your licence

The site itself — its software, design, text, structure, the way the records are compiled and presented, and the analysis we produce — belongs to us or our licensors. Subject to these Terms we give you a personal, non-exclusive, non-transferable, revocable licence to use the site and, for paid products, to use what you receive for your own work and your own clients.

You get no ownership of anything, and nothing here transfers rights in the underlying government and third-party sources, which remain subject to their own terms. Our compilation and presentation being protected does not make the underlying public records ours.

11. Third-party data and attribution

Deep Oʻahu displays material from sources that carry their own terms, licences and attribution requirements. Those obligations travel with the data, and they apply to you as well as to us if you export or reuse it.

  • Government public records — City and County of Honolulu Real Property Assessment Division, State of Hawaiʻi GIS, Honolulu ArcGIS services, the City's open-data portal, and other agencies named on our Data and methodology page. Each is used on its own published terms.
  • Aerial imagery — City and County of Honolulu 2024 aerial imagery, credited on the map wherever it is displayed.
  • Basemap — OpenFreeMap, built from OpenStreetMap data. OpenStreetMap data is published by the OpenStreetMap contributors under the Open Database Licence, which carries attribution and share-alike obligations of its own.
  • Map rendering — MapLibre GL JS, used under its open-source licence.

Attribution for what is on screen is shown on the map.

12. Feedback

If you send us a suggestion, we may use it to improve the product without owing you anything for it. That does not give us rights in your confidential material or your personal information, which are covered by our Privacy Policy.

13. The service will change

We may add, change, suspend or discontinue features, layers and datasets. Sources go away, change format, or stop being licensable, and infrastructure has outages. We do not promise uninterrupted availability, and we do not promise that any particular source or layer will still be there tomorrow. Where a change materially reduces something you are paying for, section 7 gives you an exit.

14. Disclaimer of warranties

To the fullest extent the law allows, the site and everything in it are provided "as is" and "as available", without warranty of any kind, express or implied. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and we do not warrant that the site or its data are accurate, complete, current, error-free, uninterrupted, or sufficient for any decision, transaction or professional determination.

Some jurisdictions do not allow the exclusion of certain warranties, and nothing here excludes what cannot lawfully be excluded.

15. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost opportunities, lost data or transaction losses, arising from your use of or inability to use the site, from reliance on anything in it, from an error in a source record, or from a feature being unavailable — even if we were told such damages were possible.

Our total aggregate liability for all claims arising out of or relating to these Terms or your use of the site will not exceed the greater of the amounts you paid Deep Oahu LLC in the 12 months before the claim, or one hundred US dollars (US$100). Nothing in these Terms limits liability for fraud, willful misconduct, or anything else the law does not permit to be limited.

16. Your responsibility for misuse

To the extent the law allows, you are responsible for claims, losses and costs arising from your unlawful use of the site, your breach of these Terms — section 5 in particular — or your misrepresentation of Deep Oʻahu output as something it is not. Any indemnity for a business or enterprise customer belongs in that customer's written agreement, not here.

17. Termination

You can stop using the site at any time, and close your account when accounts exist. We can suspend or terminate access as described in these Terms. Anything that should outlive the agreement does: amounts already owed, the intellectual-property terms, the disclaimers, the liability limit, and the governing-law provisions.

18. Governing law and disputes

These Terms are governed by the laws of the State of Hawaiʻi, without regard to its conflict-of-laws rules, except where a consumer-protection law that applies to you says otherwise. You and Deep Oahu LLC submit to the exclusive jurisdiction of the state and federal courts located in Honolulu, Hawaiʻi.

19. Changes to these Terms

We may update these Terms. The effective date at the top says which version is in force. For a material change, and for any change affecting a paid product, we will give notice a reasonable time before it takes effect and it will not apply retroactively to a period you have already paid for.
